On May 16, 2018, I.G. was returning home with his friends through Khizanishvili Street where he and his friend were detained by the police for committing an offense under Article 173 of the Administrative Offenses Code of Georgia, which envisages non-compliance with a lawful order or demand of a law enforcement officer or verbal and /or other abusive act against such person.
It is noteworthy that the detained did not accept the protocol of the offense drawn up by the police and presented his views regarding the case to the court with the help of lawyers of the GYLA’s Legal Aid Center.
On May 28, 2018 the police submitted the evidence before the court hearing, in particular, the records of the body camera which could not confirm the verbal abuse against the law enforcement officers by I.G. Other eyewitnesses interviewed by the GYLA's lawyer at the court trial completely excluded the commission of any kind of any offense by the detainee.
On July 20, 2018, Tbilisi City Court rendered a court ruling on termination of the administrative proceedings against I.G. due to the absence of an offense.
The second person detained in the same incident, who was filming the case with his personal mobile phone, refused to enjoy the right of having a defense counsel, and therefore the GYLA's lawyers did not have the opportunity to protect his interests. Due to the lack of direct evidence, the Court recognized him as an offender and was fined according to the Administrative Offenses Code of Georgia.
